The computer system (CS) was significantly faster than the manual system (MS) for lung function evaluation (CS=7.63 min/test, MS=12.25 min/test), loan of equipment (CS=0.40 min/loan, MS=2.07 min/loan), and checking for overdue equipment (CS=0.49 s/record, MS=9 s/record). The production of correspondence was slightly slower with the computer (CS=9.30 min/letter, MS=8.54 min/letter). b. All outpatient episodes, but only 43 of 65 (66%) of inpatient episodes, were captured. Lung function and managerial report data were accurate using both manual and computerised methods. The manual system for equipment loans was inefficient, and use of the computer resulted in the recovery of 221 nebulisers. c. Development costs for 1988–1990 were high (£72 178). Only £1200 to £1845 per year was recovered directly from staff time saved by the computer but larger savings resulted from changes in work practice (£4049–4765). After 10 years the projected deficit is £10 000 per annum in running costs.Conclusions—In comparison with the manual methods, the computer system has shown significant advantages which provide accurate information, with significant favourable effects on working practices. In evaluating computer systems used in clinical practice it is essential to ensure that the projected work practice benefits are achieved without unacceptable costs in staff time, inaccurate data and high financial outlay. This article concerns the prescriptive function of decision analysis. Consider an agent who must choose an action yielding welfare that varies with an unknown state of nature. It is often asserted that such an agent should adhere to consistency axioms which imply that behavior can be represented as maximization of expected utility. However, our agent is not concerned the consistency of his behavior across hypothetical choice sets. He only wants to make a reasonable choice from the choice set that he (...) actually faces. Hence, I reason that prescriptions for decision making should respect actuality. That is, they should promote welfare maximization in the choice problem the agent actually faces. Any choice respecting weak and stochastic dominance is rational from the actualist perspective. (shrink)

This paper is a reaction to G. Küng's and J. T. Canty's Substitutional Quantification and Leniewskian quantifiers'Theoria 36 (1970), 165–182. I reject their arguments that quantifiers in Ontology cannot be referentially interpreted but I grant that there is what can be called objectual — referential interpretation of quantifiers and that because of the unrestricted quantification in Ontology the quantifiers in Ontology should not be given a so-called objectual-referential interpretation. I explain why I am in agreement with Küng and Canty's recommendation (...) that Ontology's quantifiers not be substitutionally interpreted even if Leniewski intended them to be so interpreted. A notion of an interpretation which is referential but yet which does not interpret as an assertor of existence of objects in a domain is developed. It is then shown that a first order version of Ontology is satisfied by those special kind of referential interpretations which read as Something as epposed to Something existing. (shrink)

Natural law theories affirm that it belongs to the nature of law to be apt to promote the common good or do something similar. I defend a weak version of this thesis according to which part of what constitutes something as a nondefective central case of a posited law is that it is apt to promote the common good. Just as the rules of Pictionary require the drawing player to design her drawing to reveal the word in play, the rules (...) of a central case of a legal system require lawmakers to design laws to promote the common good. Therefore, just as a Pictionary drawing that is inapt to reveal the word in play is defective, a central case of a posited law that is inapt to promote the common good is defective. (shrink)

Econometric analysis of discrete choice has made considerable use of random utility models to interpret observed choice behavior. Much empirical research concerns choice problems in which persons act with partial knowledge of the utilities of the feasible actions. Economists use random expected utility models to analyze such choice problems. A common practice is to specify fully the expectations that persons hold, in which case choice analysis reduces to inference on preferences alone. However, the expectations assumptions made in empirical research rarely (...) have much foundation. To enable more credible research, this paper considers inference when one specifies a set of expectations that decision makers may plausibly hold. I first pose the idea in abstraction and then specialize to binary response with linear utilities, where the analysis is particularly straightforward. I initially assume that decision makers possess unique subjective probability distributions on the states of nature and make choices that maximize expected utility. I later consider the possibility that persons place only partial probabilistic structure on the states of nature and make undominated choices. (shrink)

Procopius employs the motif of “grieving in silence” to describe the deliberations preceding Justinian’s invasion of Vandal North Africa in 533 (Wars 3.10.7-8) and his vendetta against the urban prefect of Constantinople in 523 (HA 9.41). The particularity of Procopius’ language in these passages makes their collocation especially pronounced. The distance between the Wars and the Secret History, which represents itself breaking the silence between what the Wars can state publicly and the unvarnished truth (HA 1.1-10), may be measured by (...) two “wise advisers” who speak when others are silent: the quaestor Proclus, warmly remembered for his probity, and the praetorian prefect John the Cappadocian, a figure universally reviled. Discontinuities between the presentation of John in the Wars and the merits of the policies he endorses problematize readers’ impressions of not only John but also the relationship between the Wars and the historical reality the work claims to represent. The recruitment and socialization (enculturation) of spirit mediums in the United States is investigated through ethnographic interviews, participant observation and library biographies in Lily Dale, New York. Spirit mediumship, alleged transfer of information from departed souls to the living through another living human (the medium) is a deviant way of knowing in this society. Most children with signs of mediumistic ability are discouraged by family and community. Moving into the role requires positive definitions and social support, such as in Spiritualist (...) Church classes. Given general scepticism about intuition in Western society, even mediums themselves look for "confirmations" to validate their nonrational communications. Thus, the dominance of scientific rationality is accepted to an important degree even by this group that practices an alternate way of knowing. (shrink)

While correctly describing the differences in current practices between experimental psychologists and economists, Hertwig and Ortmann do not provide a compelling explanation for these differences. Our explanation focuses on the fact that psychologists view the world as composed of categories and types. This discrete organizational scheme results in merely testing nulls and wider variation in observed practices in experimental psychology.

Since structural descriptions rather than ostensive ones are required by the logic of the cultural sciences, the Platonic eidos as a regulative idea continues to play a creative role in establishing the formal unity of historical concepts. Paul Natorp, Troeltsch’s neo-Kantian contemporary and early proponent of the logicist thesis in Germany, first construed mathematical logic as a Platonistic search for the unconditioned in the form of absolutely foundational concepts or categories of thought. The hidden Platonism expressed in Troeltsch’s formal logic (...) of history is rather close to Natorp’s reading of the Platonic ideas as functions of knowledge, as methods, unities, and pure postulates of thought whose cognitive role is to be comprehensive, heuristic, and revelatory. Moreover, such characteristic 19th-century Hegelian histories of philosophical concepts as those of Adolf Trendelenburg and Gustav Teichmüller, or F. C. Bauer’s dialectical historical methodology of congruence and manifestation in ecclesiastical historicity, were Platonically oriented in that development meant fulfillment as abstract pristination [[sic]] or as the progressively emergent pure logic of historical ideas. The same climate of thought is expressed in F. H. Bradley’s version of the Identity of Indiscernibles and a Platonic-Hegelian ascent of concepts is present even later in Nicolai Hartmann’s neo-idealist treatment of the realization of concepts as "living spirit" in the progressive movement of research itself. These perspectives include (1) the science of DNA and genetics; (2) genetic engineering; (3) the ethics of manipulating genetic material; and (4) DNA in culture and religion. Various views of DNAprovide insights into human nature beyond its molecular composition.

This essay reviews three recently published books on the intellectual history of the Italian Renaissance. In his survey of Italian humanism in the “long fifteenth century” (c. 1350–c. 1525) The Intellectual World of the Italian Renaissance, Christopher Celenza argues that the intellectual project of the humanists was centred on questions regarding language, philosophy, and the stance of the intellectual toward institutions. Celenza traces the fortunes and mutations of the humanist project into the modern era in The Italian Renaissance and the (...) Origins of the Humanities, and expresses concern that in today's universities the balance struck by the humanists between “openness” and “boundary-generating habits” unduly favours the latter. Humanism, according to James Hankins's Virtue Politics, was primarily about repairing politics by first reforming the moral character of Italy's ruling elites. The language and literature of Roman and Greek antiquity provided the models for this education in virtue. Hankins believes the humanists' educational and cultural programme offers a salutary corrective to our misplaced, post-Machiavellian trust in legal constraints and constitutional guardrails to regulate contemporary political life. Nevertheless, Goncharov showed that for each $n < \omega$, there exists a computable structure with computable dimension $n$. In this paper we show that, under one natural definition of relativized computable dimension, no computable structure has finite relativized computable dimension greater than 1.

In a survey of information theory and some of its implications, Warren Weaver has proposed a distinction between engineering noise and semantic noise. Ordinary Spanish usage reflects this distinction quite neatly. If A speaks to B and B responds with no entiendo, it means ‘I have not heard your words, because of interfering sound or lack of attention; please transmit the same message again’; if he responds with no comprendo, it means ‘I heard you all right, but what I heard (...) doesn't make sense; please paraphrase or explain.’ Channel noise, thus, is the responsible factor when that which leaves a transmitter is not that which reaches the receiver; semantic noise is a discrepancy between the codes used by transmitter and receiver. Fundamental to this effort is Africana Philosophy's work to bring race, race thinking, and racism to the fore of philosophical examination. In the wake of Africana Philosophy's influence, discussions of race, race thinking, and racism are becoming central to regular philosophical discourse. The production of introductory works on race and philosophy and works examining the place (...) of race and race thinking in the history of European canonical philosophy points to philosophy's growing self awareness of race as foundational to what philosophy as a body of knowledge is and its self awareness of how race and race thinking informed the development of the field. These types of texts contribute to the normalization of race as a subfield of philosophy. Specifically, this essay will analyze four contemporary texts that exemplify this trend and what they contribute to mainstream philosophy's evolution as a site that understands race and race's role as a part of human experience and a necessary part of the larger philosophical project. Despite their diversity and ecological importance, many areas of the SAR—Stramenopila, Alveolata, and Rhizaria—clade are poorly understood as the majority of SAR species lack molecular data and only 5% of species are from well-sampled families. Here, we review and summarize the state of knowledge about the three major clades of SAR, describing the diversity within each clade and identifying synapomorphies when possible. We also assess the “dark area” of SAR: the morphologically described species that are missing molecular data. The majority (...) of molecular data for SAR lineages are characterized from marine samples and vertebrate hosts, highlighting the need for additional research effort in areas such as freshwater and terrestrial habitats and “non-vertebrate” hosts. We also describe the paucity of data on the biogeography of SAR species, and point to opportunities to illuminate diversity in this major eukaryotic clade. Nowadays ethics plays a vital role in numerous professions. Due to social requirements and technical advances, changes in the accreditation rules in legal, economic, medical and engineering education have emerged in many countries, often requiring the inclusion of an ethics requirement in such professional programmes. In this work, the authors demonstrate that such changes are absolutely necessary in the legal profession in Lithuania. Specifically, the record low level of prestige of the judiciary and lawyers in the Lithuanian society and the (...) fact that lawyers are often accused of legal nihilism, clannish behaviour, and protectionism, demand that legal ethics assumes a far greater role in Lithuanian legal education. It is necessary to stress that the topic of lawyers’ ethical violations and the consequences of such violations is discussed in the society in only in a fragmentary, and not transparent manner; moreover, the significance of ethics in the education and training of lawyers has not been properly evaluated either. Especially having in mind Lithuania’s Soviet heritage (during most of the Communist era there was almost no education on those issues), it becomes obvious that legal ethics must be continuously stressed in the legal profession’s education and development. The importance and relevance of this topic is primarily determined by the current evaluation of lawyers in Lithuania, which shows that lawyers do not fulfil the expectations of the society. This raises a question whether law graduates indeed acquire this system of ethical values as part of the process of obtaining the knowledge and skills that are necessary for a modern lawyer. While analysing the Lithuanian legal documents governing the requirements for legal studies, it has been noticed that a course in legal ethics or lawyer’s professional responsibility is not compulsory either in the qualification requirements for judges, or in the Ruling of the Constitutional Court of 20 February 2008 on legal education for those who want to assume the position of a judge according to the order of law. In the description of legal study programmes, courses on professional ethics are designated as an optional non-legal subject, which is quite different from the legal education systems of other countries, where this type of course is compulsory for future lawyers. Even if this course is taught at Lithuanian higher education establishments, it is limited to the analysis of cases and legal regulation. Insufficient attention to this issue obviously creates the erroneous impression that it is of secondary importance for a lawyer. It should be noted that legal ethical standards, the development of lawyers’ value systems and other problematic questions related to legal ethics have not attracted attention of the Lithuanian scholars either. Therefore, this is a question of the utmost importance for legal education and requires additional research. In global educational and other academic literature, much is being discussed about the methods of teaching ethics, and the place of ethical subjects in study programmes and assessment. It is well worth supporting the research on the development of lawyers’ value systems, in that the lack of such values may influence the evaluation of the practicing lawyers’ satisfaction with their job, self-confidence and belief in the importance of their profession. Obtaining social-ethical attitudes and perspectives helps future lawyers gain more trust in their professional identity and the correctness of their professional work. The main conclusions drawn from the research are the following: (1) the university can and needs to contribute to the development of students’ value systems and this is one of the most important content requirements within the legal study programmes; (2) while teaching ethics, the primary focus must be not on the legal acts regulating ethics, which are changing over time, but on the aim of helping that students themselves have an increased sense of selfawareness and sensitivity to ethical issues in law practice, recognise and understand ethical dilemmas arising in the law, recognise the dominant attitudes in the society towards the role of a lawyer and motivate them to reconsider and discuss the value bases of such attitudes and their change; (3) a course on legal ethics – no matter how perfect it would be – is not the only way to develop a personal value system. In this context, the importance of liberal arts education should be accentuated. Given the research conducted, there is a clear link between the development of moral awareness and the person’s education in general. (shrink)
